Terms & Conditions

Obligations of the Trainee/Student (HGV)

  1. The Trainee/Student will be in possession of all necessary legal driving documents at all times while undertaking any course.
  2. The Trainee/Student will show to the Theory Test centre and DSA examiner a form of photographic ID, their current driving licence, the correct entitlement and, where appropriate, a valid theory test pass certificate, on the day of their theory or practical driving test. If these conditions are not meet the Trainee/Student will fail the relevant test and will forfeit all fees paid to Newcroft in relation to that test.
  3. If the Trainee/Student is considered by Newcroft or its accredited Training Partners to be under the influence of alcohol or illegal drugs at any time, the course will be terminated, and all relevant fees will be forfeited.
  4. It is the responsibility of the Trainee/Student to ensure the correct Provisional Entitlement has been added to his/her driving licence by the DVLA. Any trainee without the correct entitlement will not legally be allowed to train and all monies paid towards course fees will be forfeited.
  5. It is the responsibility of the Trainee/Student to ensure their driving licence is valid. If a Trainee/Student is banned from driving at any point during any course – any monies paid are non-refundable.
  6. It is the responsibility of the Trainee/Student to attend his/her training course on the dates provided. If the Trainee/Student wishes to change the dates provided, they must provide at least 21 days’ notice, or this will be treated as a cancellation.
  7. Whilst attending any course with Newcroft or their Training Partners the Trainee/Student must conduct themselves in an appropriate manner. Newcroft reserve the right to terminate a course without notice, should they, in their reasonable discretion, decide that a Trainee/Student has acted or behaved inappropriately, including but not limited to, verbal and physical abuse towards Newcroft staff or Training Partner staff. If a Trainee/Student wishes to appeal such a decision they should do so to the Operations Manager, Newcroft Training Ltd, 35 Progress Road Leigh-On-Sea SS9 SPR.

Obligations of the Trainee/Student (Forklift)

  1. The Trainee/Student will provide accurate and full information to Newcroft at all times.
  2. The Trainee/Student will be in possession of an RTITB registration number or documentation that proves relevant experience while undertaking any course other than Novice.
  3. If the Trainee/Student is considered by Newcroft or its accredited Training Partners to be under the influence of alcohol or illegal drugs at any time, the course will be terminated, and all relevant fees will be forfeited.
  4. It is the responsibility of the Trainee/Student to attend his/her training course on the dates provided. If the Trainee/Student wishes to change the dates provided, they must provide at least 21 days’ notice, or this will be treated as a cancellation.

  1. The Trainee/Student will provide accurate and full information to Newcroft at all times.
  2. The Trainee/Student will be in possession of appropriate evidence of prior training or qualifications for all non-novice courses.
  3. If the Trainee/Student is considered by Newcroft or its accredited Training Partners to be under the influence of alcohol or illegal drugs at any time, the course will be terminated, and all relevant fees will be forfeited.
  4. It is the responsibility of the Trainee/Student to attend his/her training course on the dates provided. If the Trainee/Student wishes to change the dates provided, they must provide at least 21 days’ notice, or this will be treated as a cancellation.

Training with Newcroft

Course lengths vary from 4 – 35 hours depending on the maximum permitted Trainer/Student ratio permitted.
Training days last no longer than 8 hours excluding breaks apart from LGV driver training which is limited to a maximum of 4 hours per day.
Training can start at various times during the day but generally no earlier than 6am for HGV training on a test day or 8am for all other days. The latest time training starts is 2pm on any day and the latest it finishes is 6pm (or 7pm if the course is due to complete).
HGV driver training is carried out on a 1 to 1 basis. All other training has a maximum of 3 to 1 apart from Driver CPC training which has a maximum of 20 to 1.
In the event of the training vehicle breaking down, Newcroft will arrange for the Trainee/Student to have a replacement vehicle of a similar standard and spec, if this is not possible further training to make up for the lost time at a time convenient for the Trainee/Student and at no extra cost.
In the event that a course is cancelled due to instructor illness, Newcroft will rebook the course for an alternative date convenient for the Trainee/Student and at no extra cost.
In the event that a trainee fails to complete or attend their course for whatever reason including but not limited to certified sickness then all course fees will be forfeited. Subject to managers discretion.
The Trainee/Student will accept that is the LGV instructor believes that a Trainee/Student is not fit to take his/her LGV practical test for reasons of safety, the Trainee/Student will be informed, and the test re-scheduled at the Trainee/Student’s expense.
Any complaints about the LGV Course should be directed to the Operations Manager. Newcroft will endeavour to reply within 21 days

Payment Terms

Course fees vary therefore Trainee/Students should contact Newcroft directly for details of current course fees. Course fees will be guaranteed for 56 days from date of first payment.
All course fees advertised are exclusive of VAT.
A deposit of 50% will be accepted providing it is paid more than 14 days prior to the course commencing.
All balances must be paid in full before course commencement.

Cancellation and Refund Policy

If any Trainee/Student cancels their booking more than 48 hours of the course commencing and doesn’t want to rebook, then monies paid will be refunded in full provided the booking was made without face to face contact. This clause is in accordance with the Distance Selling Regulations, 2000′.
Cancellations can be made by phone, e-mail or in writing and sent by registered post to: Newcroft Training Ltd 35 Progress Road Leigh-On-Sea SS9 SPR.
The term ‘Course Bookings · and ‘Booking· applies to trainees/students who have made full or part payment on any course sold by Newcroft.
Any Trainee/ Student who cancels their booking less than 48 hours of the course commencing will not receive a refund unless they wish to rebook.
A Trainee/Student who for whatever reason cancels their booking 3 times will not receive a refund even if they wish to rebook.
Any refund approved will be returned to the Trainee/Student within 21 working days from receipt of the request.
If a Trainee/Student has had their course dates confirmed and left a deposit, no refund is available. If genuine medical reasons preclude the Trainee/Student from attending the course. then if possible (and on the production of proof), then Newcroft will endeavour to re-book the Trainee/Student on other course dates if possible. This change of dates will not incur booking fees providing the course cancelled is not less than two weeks away.

Confidentiality and Data Protection

Newcroft will keep confidential information which the Trainee/Student supplies to Newcroft in connection with this agreement, with the exception of basic personal details which may be shared with partner schools.
Newcroft will be responsible for ensuring that the processing of personal data complies with the Data Protection Act 2018.

Other Terms

This agreement is governed by English law. Both Newcroft and the Trainee/Student submit to the exclusive jurisdiction of the English and Welsh courts in relation to any dispute concerning this agreement.
By paying the Registration Fee the Trainee/Student agrees to be bound by the above terms.
